1) Getting a complete AI system inventory

The challenge: You can’t comply with what you can’t see—shadow models, “small” scripts, and vendor features slip past legal and security.

How to overcome it: Stand up a single, living registry for every model and AI-enabled feature (internal and third-party). Capture purpose, users, data in/out, jurisdictions, deployment method (API/SaaS/embedded), and owners. Make “new AI = new record” part of your SDLC gates.

2) Untangling your legal role (provider vs. deployer)

The challenge: Your obligations swing wildly depending on whether you “provide” (place on market) or “deploy” (use under your authority)—and many companies are both.

How to overcome it: Map roles per use case, not per company. Create a simple RACI for provider/deployer/importer/distributor tasks and mirror it in contracts, onboarding checklists, and vendor reviews.

3) Classifying risk correctly (and early)

The challenge: Misclassifying a system—especially missing a high-risk Annex III use case or a safety component—creates rework at the worst moment.

How to overcome it: Build a short pre-screen: “Is it biometric? Employment/education? Access to essential services?” If “yes,” route to a deeper Annex III review. Keep examples and precedents in a playbook so product teams can self-serve.

4) Producing Annex IV technical documentation that’s audit-ready

The challenge: Teams try to write tech docs at the end and discover they never saved the evidence (datasets, tests, mitigations, change logs).

How to overcome it: Document as you build. Use templates with required sections (system description, intended purpose, data governance, evaluation, robustness, oversight, cybersecurity, update policy). Store artifacts in versioned folders; link evidence directly from the doc.

5) Data governance and quality (bias, representativeness, drift)

The challenge: “Good enough” data practices won’t pass scrutiny if outcomes differ across protected attributes or shift after deployment.

How to overcome it: Define sampling plans, hold-out sets for fairness checks, and thresholds for action. Track lineage for every dataset. In production, monitor drift and re-validate periodically; log what changed and why.

6) Making human oversight real—not performative

The challenge: Slideware says “a human can intervene,” but there’s no clear trigger, UX, or escalation path.

How to overcome it: Specify decision points a human actually sees, with pause/override tools, rollbacks, and audit trails. Train the humans (playbooks, simulator runs). Measure effectiveness (e.g., time to intervene, false override rate) and iterate.

7) Meeting transparency obligations in product UX

The challenge: Teams forget disclosures until last mile: chatbot interaction notices, synthetic media labels, biometric/emotion recognition notices.

How to overcome it: Create reusable UI patterns and copy that satisfy disclosure rules without ruining UX. Log when and how disclosures were shown. Include transparency checks in design reviews and release checklists.

8) Picking the right conformity-assessment path (and QMS depth)

How to overcome it: Run an early gap assessment against QMS expectations (design controls, supplier management, change control, validation, post-market monitoring). Decide the path, then schedule time for evidence generation, internal audits, and (if needed) pre-assessment with a notified body.

9) Post-market monitoring and incident reporting clocks

The challenge: Once live, you need telemetry to detect performance or safety issues and a playbook to report serious incidents on time.

How to overcome it: Instrument for accuracy, robustness, and safety signals at launch. Define thresholds, ownership, and on-call. Write an incident runbook (legal + comms) and rehearse it. Keep remediation notes with the technical file.

10) Third-party and GPAI dependencies

The challenge: Many products rely on vendors or general-purpose models. If upstream documentation or safety practices are thin, your file will be too.

How to overcome it: Require model cards, security attestations, training-data summaries (as available), and change-log notifications in contracts. Maintain an “SBOM for models” listing versions, eval results, and known limitations. Re-evaluate vendors after major updates.
